Side or rear attack

On page 58 it indicates that when a unit is attacked from the side, or rear, its defender modifier is zero, and the defense clauses do not apply (militia, melee weapons, tenacious, battalion guns). Is it?

If I decide not to perform a maneuver test, is the zero factor guaranteed, or is automatically disorder?

Is that correct?

Yes some defensive factors do apply, it generally say which don't apply in the factor descriptions on pages 58/59. So Tenacious and battalion guns don't apply but Militia and Melee do. Common modifiers also apply
